Defense attorney wants a new judge in Peoria doctor’s murder case

PEORIA (WEEK) — The attorney representing Robert Ely, the man accused of killing prominent Peoria physician Dr. William Marshall, says he does not want Judge Kevin Lyons to oversee his client’s case.

Chicago-based attorney William Wolf declined to say why he wants a new judge. In addition to Lyons, he also does not want Judge John Vespa to be involved in future proceedings.

Wolf is expected to file a motion for reassignment. That will be handled by Chief Judge Katherine Gorman.

Ely was first arraigned on June 17, where he was charged with first-degree murder in the death of 92-year-old Marshall. His bail remains set at $5 million.

Ely appeared in court on Thursday via video conference, during which his attorney entered an “informal” not guilty plea. That plea will have to be made again if a new judge is assigned to the case.

When asked about the reason for a not-guilty plea with so much evidence against his client put out to the public, Wolf said there’s been no evidence presented, rather all the public has heard is “a lot of talk.”
